These Terms and Conditions govern all reservations, transportation services, shared tours, private tours, attraction admissions, airboat experiences, and related services offered or arranged through:

By submitting a reservation request, accepting a quote, making a payment, or participating in a service booked through this Website, the customer confirms that they have read, understood, and agreed to these Terms and Conditions.

1. Scope of Services

The Website offers or arranges services related to visits to the Florida Everglades, which may include:

  • Shared transportation from selected Miami Beach and Downtown Miami locations.
  • Private transportation to and from the Everglades.
  • Shared or private Everglades excursions.
  • Airboat rides.
  • Wildlife presentations or exhibits.
  • Attraction admission tickets.
  • Transportation for families and private groups.
  • Services operated or provided by independent third parties.

The exact itinerary, pickup location, schedule, inclusions, exclusions, price, and cancellation conditions will be shown on the applicable booking page, quote, invoice, voucher, or written confirmation.

2. Role of the Company

Miami Beach Tours and Services ACS LLC may provide transportation directly or may arrange transportation, airboat rides, attraction admission, wildlife presentations, tours, or related services through independent third-party providers.

Depending on the reservation, the Company may act as:

  • A transportation provider.
  • A booking coordinator.
  • A ticket reseller.
  • An intermediary between the customer and an independent operator.
  • A combination of the above.

The airboat ride, attraction, wildlife presentation, park operations, and related activities may be performed entirely by an independent Everglades attraction or tour operator.

3. Reservation Confirmation

A reservation request or quote does not guarantee availability.

A reservation is confirmed only after:

  1. The customer provides all required information.
  2. The required payment or deposit is received.
  3. The Company issues a written confirmation.

Reservations are subject to vehicle capacity, attraction availability, operating schedules, weather conditions, and third-party provider availability.

The customer must review the confirmation and report any incorrect information promptly.

4. Customer Information

The customer is responsible for providing complete and accurate information, including:

  • Full passenger name.
  • Telephone number with country code.
  • Email address.
  • Service date.
  • Number of passengers.
  • Selected pickup location.
  • Hotel name or exact address, when applicable.
  • Ages of children.
  • Mobility or accessibility requirements.
  • Any relevant special request.

The Company is not responsible for missed services, delays, additional charges, or other consequences caused by inaccurate, incomplete, or late information supplied by the customer.

5. Prices

Unless otherwise indicated, prices are shown in United States dollars.

Prices may be advertised on a per-person, per-vehicle, or per-group basis.

A price advertised as “from” or “starting at” represents the lowest available price for a particular service, pickup area, schedule, passenger category, or booking condition. The final price will be displayed or confirmed before payment.

Prices include only the items expressly described on the booking page or written confirmation.

Unless specifically stated, prices may not include:

  • Meals or beverages.
  • Gratuities.
  • Optional photographs.
  • Optional animal encounters.
  • Additional attraction activities.
  • Hotel parking.
  • Additional transportation.
  • Excess waiting time.
  • Services not included in the confirmed itinerary.

6. Payments and Processing Charges

The payment amount and required payment schedule will be stated during booking.

Accepted payment methods may include:

  • Zelle.
  • Credit or debit card.
  • Venmo.
  • Wise.
  • Cash, when expressly authorized.
  • Other approved electronic payment methods.

A processing charge of up to 4% may apply to credit card, debit card, Venmo, Wise, or other processed payments when disclosed before payment.

Zelle and authorized cash payments generally do not carry a processing charge unless otherwise stated.

Electronic payment, online acceptance, email confirmation, or written acceptance through a messaging service may serve as evidence of the customer’s agreement to these Terms. Florida law generally provides that a contract or signature cannot be denied legal effect solely because it is in electronic form.

7. Shared Everglades Services

Shared tours and shared transportation operate according to scheduled departure times.

Shared services may include:

  • Multiple hotel or meeting-point pickups.
  • Multiple passengers with separate reservations.
  • Different pickup and drop-off locations.
  • A vehicle or driver change.
  • Adjustments to the pickup order.
  • Centralized pickup points.

The estimated pickup time is not necessarily the exact departure time from Miami. Additional pickups may occur before traveling to the Everglades.

Passengers must be ready before the confirmed pickup time and remain available by telephone or WhatsApp.

Shared vehicles cannot wait indefinitely for late passengers. A passenger who misses the scheduled outbound or return departure will be responsible for arranging and paying for alternative transportation.

8. Pickup Areas and Meeting Points

Pickup may be available from selected hotels or meeting points in Miami Beach and Downtown Miami.

Pickup is not guaranteed from every hotel, residence, vacation rental, airport, cruise terminal, or private address.

The Company may assign a nearby meeting point when direct pickup is unavailable or operationally impractical.

The confirmed pickup point shown in the reservation confirmation will control.

The passenger is responsible for arriving at the correct location on time.

9. Pickup and Return Times

Pickup and return times are approximate unless expressly guaranteed in writing.

Schedules may be affected by:

  • Traffic.
  • Weather.
  • Road closures.
  • Passenger delays.
  • Vehicle availability.
  • Attraction operating conditions.
  • Police activity.
  • Mechanical issues.
  • Airboat schedules.
  • Other circumstances beyond reasonable control.

Customers should not schedule flights, cruises, appointments, or other time-sensitive activities immediately after the estimated return time.

The Company does not guarantee arrival or return at an exact time.

10. Airboat Rides and Attraction Operations

Airboat rides, wildlife presentations, exhibits, admission facilities, and attraction activities may be operated by an independent third-party attraction.

The independent operator controls:

  • Attraction opening and closing times.
  • Airboat departure times.
  • Ride duration.
  • Safety rules.
  • Seating arrangements.
  • Wildlife presentations.
  • Exhibits.
  • Available activities.
  • Operational cancellations.
  • Admission requirements.

The Company does not control the daily operations of an independent attraction and cannot guarantee that every advertised activity will be available on a particular date.

11. Wildlife Sightings

The Everglades is a natural environment.

Wildlife sightings, including sightings of alligators, birds, turtles, fish, or other animals, cannot be guaranteed.

Animal location and activity depend on weather, water levels, temperature, season, time of day, and other natural conditions.

The absence of a particular wildlife sighting does not constitute a service failure and does not entitle the customer to a refund.

12. Weather and Attraction Closures

Everglades services may operate during light rain or changing weather conditions.

The attraction or airboat operator may delay, modify, suspend, shorten, or cancel an activity because of:

  • Thunderstorms.
  • Lightning.
  • Heavy rain.
  • High winds.
  • Flooding.
  • Mechanical problems.
  • Safety concerns.
  • Government orders.
  • Park conditions.
  • Other operational reasons.

When an activity is canceled by the operator, the available remedy will depend on the operator’s policy and the unused portion of the customer’s reservation.

Transportation already performed may remain chargeable even when an attraction activity is shortened or canceled after arrival.

13. Changes Requested by the Customer

Changes are subject to availability and are not guaranteed.

Changes involving the date, passenger count, pickup location, service type, vehicle, or itinerary may result in a revised price.

A requested change is not confirmed until approved in writing by the Company.

A substantial change may be treated as a cancellation of the original reservation and the creation of a new reservation.

14. Cancellations and Refunds

The cancellation policy displayed on the booking page, quote, invoice, or written confirmation will apply to the reservation.

Unless a different policy is stated:

  • Cancellations received at least 48 hours before the scheduled pickup time qualify for a full refund.
  • Cancellations received less than 48 hours before the scheduled pickup time are non-refundable.
  • No-shows are non-refundable.
  • Missing a shared outbound or return departure is non-refundable.

Admission tickets or third-party reservations that have already been issued may be non-refundable if this condition was disclosed before purchase.

Approved refunds are generally initiated within two to five business days. Banks and payment processors may require additional time to credit the customer’s account.

If the Company cannot provide or arrange a confirmed service, the customer will receive a refund of the amount paid for the affected service.

15. Independent Providers and Subcontracted Drivers

Miami Beach Tours and Services ACS LLC may arrange all or part of a service through independent transportation companies, vehicle owners, drivers, attraction operators, tour operators, guides, ticket providers, or other third parties.

Independent providers and subcontracted drivers are not employees of Miami Beach Tours and Services ACS LLC unless expressly stated otherwise.

Each independent provider is solely responsible for obtaining, maintaining, and complying with all credentials and requirements applicable to its own operations, including:

  • Driver’s licenses.
  • Commercial driver’s licenses.
  • Vehicle registrations.
  • Transportation permits.
  • Operating authorizations.
  • Commercial authorizations.
  • Vehicle inspections.
  • Insurance policies.
  • Vehicle maintenance requirements.
  • Local, state, and federal laws.
  • Attraction and boating requirements.
  • Safety regulations.

No Independent Verification

Miami Beach Tours and Services ACS LLC does not independently inspect, investigate, audit, authenticate, monitor, or verify the permits, licenses, registrations, insurance policies, operating authority, inspection records, vehicle documentation, or other credentials of subcontracted drivers or independent third-party providers.

The Company does not represent or guarantee that:

  • A third-party license or permit is current.
  • A third-party insurance policy is active.
  • A particular type or amount of insurance coverage is sufficient.
  • A provider has continuously complied with all regulatory requirements.
  • Documents or statements provided by a third party are accurate or complete.

Any information or documentation received from a third-party provider may be used for administrative or operational purposes. Receipt or possession of such information does not constitute independent verification, certification, approval, endorsement, or a guarantee by Miami Beach Tours and Services ACS LLC.

Each independent provider remains exclusively responsible for the legality, safety, maintenance, documentation, insurance, and operation of its own vehicle, vessel, attraction, personnel, and services.

The assignment or arrangement of an independent provider does not make Miami Beach Tours and Services ACS LLC an insurer, employer, partner, or guarantor of that provider.

Nothing in this section excludes or limits any legal responsibility that cannot lawfully be excluded or limited.

16. Vehicle Assignments

Vehicle photographs and descriptions are illustrative.

The Company may substitute the originally anticipated vehicle with another vehicle having similar or greater passenger capacity.

A particular make, model, year, color, or driver is guaranteed only when expressly confirmed in writing.

The passenger must disclose the correct number of passengers before booking.

17. Children and Child Seats

Children must be accompanied and supervised by a responsible adult.

Child seats must be requested before booking and are subject to vehicle type, provider availability, and written confirmation.

The accompanying adult must provide accurate information regarding the child’s age, approximate height, and weight.

The accompanying adult is responsible for inspecting the child seat before departure and confirming that the child is properly secured.

A child seat is not guaranteed unless expressly confirmed in writing.

18. Accessibility

Customers requiring wheelchair-accessible transportation, assistance with mobility devices, or another accommodation must notify the Company before booking.

Not every shared vehicle, attraction, airboat, or meeting point is suitable for every accessibility requirement.

The Company will make reasonable efforts to provide information and arrange appropriate service, subject to provider, attraction, and vehicle availability.

19. Passenger Conduct and Safety

Passengers must comply with instructions provided by drivers, attraction personnel, airboat captains, and other authorized staff.

The following conduct is prohibited:

  • Threatening or abusive behavior.
  • Interfering with a driver or airboat operator.
  • Entering restricted areas.
  • Feeding or touching wildlife without authorization.
  • Smoking or vaping inside a vehicle.
  • Carrying illegal or dangerous substances.
  • Deliberately damaging vehicles or attraction property.
  • Creating an unreasonable safety risk.
  • Excessive intoxication.

A passenger may be refused service or removed from an activity when their conduct presents a safety, legal, or operational concern.

No refund will be issued when service is refused or terminated because of passenger misconduct.

20. Personal Property

Passengers are responsible for their personal belongings.

The Company and independent providers are not responsible for property lost, stolen, damaged, or left in a vehicle, airboat, attraction, meeting point, or other location, except where liability cannot legally be excluded.

Reasonable efforts may be made to locate a reported item, but recovery is not guaranteed.

The customer may be responsible for delivery, shipping, parking, toll, or driver expenses related to returning an item.

21. Damage and Cleaning

The customer is responsible for damage or extraordinary cleaning caused by members of their reservation group.

This may include:

  • Vomiting.
  • Spilled food or beverages.
  • Stains.
  • Smoke odors.
  • Broken equipment.
  • Deliberate vehicle damage.
  • Damage to attraction property.

The customer may be charged for reasonable cleaning, repair, replacement, or loss-of-use expenses.

22. Circumstances Beyond Reasonable Control

The Company is not responsible for delays, interruptions, or service changes caused by circumstances beyond its reasonable control, including:

  • Severe traffic.
  • Accidents.
  • Road closures.
  • Weather.
  • Flooding.
  • Mechanical failures.
  • Attraction closures.
  • Government orders.
  • Police activity.
  • Labor disputes.
  • Communication failures.
  • Payment-system interruptions.
  • Passenger delays.
  • Acts or omissions of independent providers.

The Company will make reasonable efforts to provide operational assistance or an alternative when reasonably possible.

23. Limitation of Liability

To the fullest extent permitted by applicable law, Miami Beach Tours and Services ACS LLC will not be liable for indirect, incidental, special, punitive, or consequential losses, including:

  • Missed flights or cruises.
  • Missed appointments.
  • Alternative transportation.
  • Hotel expenses.
  • Lost income.
  • Lost business.
  • Loss of enjoyment.
  • Other expenses not forming part of the confirmed reservation.

The Company is not responsible for the independent acts, omissions, negligence, misconduct, accidents, regulatory violations, or service failures of an independent third-party provider, except to the extent that responsibility is imposed on the Company by applicable law.

Where legally permitted, the Company’s total liability relating to a reservation will not exceed the amount paid directly to the Company for the affected service.

These limitations do not apply to any responsibility that cannot legally be waived or limited.

24. Communications

The customer authorizes the Company to communicate using the telephone number, email address, SMS, or WhatsApp contact provided during booking.

Communications may include:

  • Payment requests.
  • Booking confirmations.
  • Pickup instructions.
  • Schedule updates.
  • Driver information.
  • Operational notices.
  • Customer-service messages.

The customer is responsible for maintaining access to the provided contact information.

25. Personal Information

Customer information may be used to:

  • Process the reservation.
  • Collect payment.
  • Communicate with passengers.
  • Coordinate transportation.
  • Issue attraction tickets.
  • Assign independent providers.
  • Prevent fraud.
  • Provide customer support.
  • Comply with legal obligations.

The minimum information reasonably required to perform the service may be shared with drivers, transportation providers, attraction operators, payment processors, and other parties involved in fulfilling the reservation.

26. Website Information and Errors

Reasonable efforts are made to maintain accurate website information.

Typographical errors, technical errors, outdated schedules, unavailable activities, or incorrect prices may occasionally occur.

The Company may correct an obvious error before confirming the reservation.

When a material error is discovered after payment, the customer may accept the corrected terms or receive a refund for the affected service.

27. Governing Law

These Terms and any dispute related to a reservation made through evergladesairboattour.miami will be governed by the laws of the State of Florida.

Unless applicable law requires otherwise, legal proceedings must be brought in a court of competent jurisdiction located in Miami-Dade County, Florida.

28. Severability

If any provision of these Terms is determined to be invalid or unenforceable, that provision will be limited or removed only to the extent necessary.

The remaining provisions will continue in effect.

29. Entire Agreement

These Terms, together with the applicable booking page, quote, payment request, invoice, voucher, written confirmation, and Privacy Policy, constitute the agreement concerning the reservation.

Service-specific terms shown in the written confirmation will control if they conflict with these general Terms.

30. Updates

These Terms may be updated periodically.

The version accepted or in effect when the reservation was made will generally govern that reservation unless a change is legally required.
